Commissions: Terms of Service (@cyberfate)

GENERAL

  1. I have the right to decline any commission that I do not feel comfortable with drawing or those that I feel I am not able to fulfill.
  2. My art is not to be used in any sort of AI programs or AI training programs, this includes NFTs.
  3. Commissions of mine are generally completed in the order that I receive them. If for any reason they are not, it is most likely there was a deadline requested.
  4. I do not have a strict work schedule. I simply draw when I feel up to it and have enough time in order to ensure quality and effort with every piece. That said, I do not open commissions when going through art block, real life problems, etc. to further ensure reasonable delivery. I am a full-time student, but I do not let it get in the way of my commissions. Though, please remember, I am human too!
  5. Frequent reminders are appreciated as I am a forgetful person and almost always caught up in something.
  6. Deadlines are allowed to be given. All I ask is that I am given a minimum of at least one week to complete the commission.
  7. My turn-around-time is generally 2 days to 2 weeks, but I will give an estimated delivery date upon commission based on my life schedule and/or your spot in my queue.
  8. Any and all references are very appreciated. This goes for character references, pose references, expressions, themes, moodboards, etc.
  9. I am happy to make revisions any time during the commission, no matter how much of it has been completed. Revisions will not be made after the final piece has been paid for and delivered. (Ex. please don’t contact me a week after and ask for changes.)
  10. I will only give updates about the art during the sketch and final stage unless requested otherwise or for more complex pieces where more elements are included.

RIGHTS

  1. Do not trace, edit, or steal my art and/or claim it as your own.
  2. By commissioning me, you consent to your commissioned artwork to be posted online on platforms such as Instagram, X, etc. I will not claim the character(s) as my own and will post it as a commissioned piece. You may request to keep the commission private upon request.
  3. My watermark is to be kept on all commissioned pieces, no matter the circumstances.
  4. My art is not to be used for commercial purposes to make your own profit. If wanted for commercial use, an additional charge to your commission will apply. This being said, my art is to be used for personal purposes only.

PAYMENT PROCESSES

  1. I take payment through PayPal only. Other accepted payments may include: discord nitro, discord profile decorations, and Robux, but are not always an option.
  2. I accept upfront and 50⁄50 payments only. My upfront payments are payments made after the sketch of your commission is sent and approved. My 50⁄50 payments are as follows, but you make the second half of the payment after the finished piece is sent. For 50⁄50, the final piece will be fully watermarked until paid for. (This does not apply to CS commissions or commissions for digital currencies as they will be taken upfront.)
  3. If the final payment is not made within 72 hours, the commission will be cancelled.

REFUND PROCESSES

A refund may be issued under these circumstances:

  1. The commission is cancelled before the first sketch is sent. A full refund will be issued, but please do not use this term as a means of trolling.
  2. I am unable to complete the art within 2 months.
  3. IF a refund is requested while the art is in a stage past the sketch, I will only give a partial refund based on how much of the art has been completed.
  4. Refunds will not be issued after the art has been completed and delivered.
